Terms of Use Agreement

BeeFreedom LLC (“BeeFreedom,” “we,” “our” or “us”) and its website with a homepage located at https://www.BeeFreedom.com, the BeeFreedom mobile application (the “App”), and the content, features and services offered on and in connection with these sites and applications (collectively, the “Platform”) are owned and operated by BeeFreedom and can only be accessed and used by users (“you” or “your”) under these Terms of Use described herein (the “Terms”).

THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS AS DETAILED IN THE ARBITRATION AND CLASS ACTION WAIVER SECTION BELOW. EXCEPT WHERE PROHIBITED BY APPLICABLE LAW, THESE TERMS REQUIRE YOU TO ARBITRATE DISPUTES WITH US RATHER THAN RESOLVE DISPUTES THROUGH A JUDGE OR JURY TRIAL, OR ANY COURT PROCEEDINGS, OR CLASS ACTIONS OF ANY KIND. BY ACCESSING, OR USING THE PLATFORM, YOU HEREBY WAIVE ANY AND ALL RIGHTS TO INITIATE OR PARTICIPATE IN ANY CLASS ACTION LAWSUIT OR REPRESENTATIVE ACTION WITH RESPECT TO ANY DISPUTES OR CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM.

These Terms, our Privacy Policy, and all other documents referenced herein govern the relationship between you, the user of the Platform, and BeeFreedom. You hereby agree that the agreement formed by these Terms is equivalent to any written, negotiated agreement signed by you. Please read these Terms thoroughly and carefully. By accessing or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, then you may not access or use the Platform. You agree to provide to BeeFreedom and authorize BeeFreedom to use your information to obtain background checks and business credit checks from our vendors and/or verify your identity throughout your use of the service in accordance with applicable laws, including but not limited to the Fair Credit Reporting Act (“FCRA”).

1. Definitions

  1. “BeeFreedom Content” means all Content BeeFreedom makes available on or through the Platform, including any Content licensed from a third-party, but excluding User Content.
  2. “Collective Content” means User Content and BeeFreedom Content together.
  3. “Content” means text, graphics, images, music, software, audio, video, information or other materials, including but not limited to profile information, Professional Services requests, quotes, message threads, reviews, scheduling and calendar information, and other information or materials available on or through the Platform.
  4. “Consumer” or “Customer” means a User who is registered to search for Service Providers on the Platform, seeks Professional Services from Service Providers on the Platform, makes a booking with a Service Provider to purchase a Professional Service (or receive a quote in contemplation thereof), agrees to these Terms, or otherwise uses the Platform, including, without limitation, to receive, pay for, review, or facilitate the receipt of Professional Services. Consumers or Customers are often referred to as “Hives ” on the Platform.
  5. “Fee” means any amount charged by BeeFreedom to a User in connection with the Platform.
  6. “Service Provider” or Service Professional means a User who uses, or is registered to use, the Platform to offer, provide, receive payment for, or facilitate the provision of Professional Services. Service Providers or Service Professionals are often referred to as “pros” or “Bees” on the Platform.

2. Changes

BeeFreedom reserves the right at any time and with or without notice to you, to change the Platform, including, without limitation, eliminating, supplementing, modifying, adding, or discontinuing any content, feature, data, or service on or available through the Platform; and the prices and Fees (if any) for access to or use of the Platform or any component thereof.

3. Eligibility

By accessing or using the BeeFreedom Platform, you represent and warrant that you are at least 18 years old, are at least of the legally required age in the jurisdiction in which you reside, and are otherwise capable of entering into binding contracts.

4. Account Registration and Other Submissions

To access and participate in certain features of the Platform, you will need to provide login information such as a username and create a password-protected account. You are solely responsible for maintaining the confidentiality of any password or other account information not generally available to others and are fully responsible for all activities that occur under your username and password.

5. Payment for Professional Services or Fees

Customer Payment

Immediately after a Customer schedules and books a service appointment with a Service Provider on the Platform for Professional Services, BeeFreedom reserves the right to, and will charge the Customer’s on-file payment method for the amount of the costs for Professional Services plus any applicable Fees.

Service Provider Payment

Upon completion and approval of Service Provider’s Professional Services, Service Provider will receive payment in the amount of the pre-set price listed on the Platform, subject to Fees due to BeeFreedom and any applicable dispute or refund policies. You agree to pay a Fee to BeeFreedom in the amount of 15% of the price of your Professional Services which were booked by the Customer through the Platform.

Cancellations

By Service Provider: All cancellations must be made exclusively through the Platform. If cancelled more than 24 hours before the appointment and rescheduled within 48 hours, no refund is issued. Otherwise, Customer receives a 100% refund.

By Customer: Cancellations more than 24 hours before: no cancellation fee. Between 6–24 hours: 30% cancellation fee. Less than 6 hours or no-show: 100% cancellation fee.

6. Disclaimer of Warranties; Limitation of Liability

DISCLAIMERS: YOUR USE OF THE PLATFORM, PROFESSIONAL SERVICES, USER CONTENT, OR COLLECTIVE CONTENT IS SOLELY AT YOUR OWN RISK. THE PLATFORM AND COLLECTIVE CONTENT IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED.

LIMITATION OF LIABILITY: IN NO EVENT WILL THE TOTAL, AGGREGATE LIABILITY OF BEEFREEDOM ARISING FROM OR RELATING TO THESE TERMS, THE PLATFORM, PROFESSIONAL SERVICES, AND/OR COLLECTIVE CONTENT EXCEED THE TOTAL AMOUNT OF FEES ACTUALLY PAID TO BEEFREEDOM BY YOU, OR ONE HUNDRED U.S. DOLLARS ($100.00 USD) IF NO SUCH PAYMENTS HAVE BEEN MADE.

7. Governing Law

These Terms shall be governed by the laws of the State of Florida, United States of America, without regard to its choice of law provisions.
